NICK ALDIERO BASKETBALL LLC
COMMITTED PLAYER PROGRAM
ENROLLMENT AGREEMENT & TERMS AND CONDITIONS
This Enrollment Agreement (“Agreement”) is entered into between Nick Aldiero Basketball LLC (“Company”) and the purchasing parent or legal guardian (“Client”) regarding the participation of the minor athlete enrolled in the Committed Player Program (“CPP” or “Program”).
By checking the required acknowledgment boxes and completing enrollment, Client acknowledges that Client has read, understands, and agrees to be legally bound by this Agreement.
1. PROGRAM TERM & ACCESS
CPP is a twelve (12) consecutive month, access-based basketball development program beginning on Athlete’s enrollment date. (as long as all procedures are followed)Â
Failure to make the second payment on the exact date due will result in access being denied. Access can potentially be removed entirely.
CPP is not sold on a per-session, per-class, per-workout, attendance, or results basis.
Enrollment provides Athlete access to eligible Program training opportunities and Program benefits made available during the Program Term, subject to scheduling, capacity, Program policies, and Client’s account remaining in good standing.
Payment is for Program access, not actual attendance, usage, or any guaranteed number of sessions.
Company may reasonably modify training schedules, days, locations, coaches, curriculum, and available training opportunities as operational needs require.
2. TOTAL PURCHASE PRICE & PAYMENT OBLIGATION
The total contractual purchase price is $6,400.
Client agrees to the following payment schedule:
Payment 1: $3,200 due immediately at enrollment
Payment 2: $3,200 due December 15, 2026
By completing enrollment, Client agrees to purchase the entire 12-month Program for the full $6,400 purchase price.
The initial $3,200 payment does not purchase only the first portion of the Program and does not give Client an option to decide later whether to make the second payment.
The second $3,200 installment is a binding contractual payment obligation and is not optional.
Client understands that the second installment remains due regardless of Athlete’s attendance, usage, loss of interest, scheduling conflicts, voluntary withdrawal, or Client’s decision not to use available Program access, except to the extent otherwise required by applicable law.
3. AUTOMATIC PAYMENT AUTHORIZATION
Client expressly authorizes Nick Aldiero Basketball LLC and its payment processor to automatically charge Client’s payment method on file:
$3,200 ON DECEMBER 15, 2026
Client agrees to maintain a valid payment method capable of processing the scheduled payment.
Client may not unilaterally cancel, postpone, delay, reschedule, reduce, or otherwise modify the December 15, 2026 payment obligation.
Any modification requires the prior written approval of Nick Aldiero Basketball LLC.
A failed, declined, blocked, expired, disputed, or otherwise unsuccessful charge does not cancel, forgive, reduce, or postpone the underlying $3,200 balance.
4. FAILED SECOND PAYMENT — IMMEDIATE SUSPENSION
If the $3,200 payment due December 15, 2026 is not successfully paid when due, Athlete’s CPP access will be suspended immediately.
During suspension, Athlete may not participate in CPP training sessions or receive Program benefits.
Suspension does not:
- extend the payment due date;
- cancel the payment obligation;
- reduce the amount owed; or
- create a right to continued Program access.
The unpaid $3,200 remains due.
5. TERMINATION FOR PAYMENT DEFAULT
If the second payment remains unpaid, Company may terminate Athlete’s enrollment in CPP and remove Athlete from the Program.
Termination or suspension resulting from Client’s payment default does not cancel, reduce, or forgive the unpaid $3,200 balance.
The outstanding balance remains due even if Athlete no longer has access to the remainder of the Program because of Client’s payment default.
Payment of an outstanding balance after termination does not automatically restore Program access. Any reinstatement requires Company’s written approval.
6. COLLECTION OF UNPAID BALANCE
If an amount properly due under this Agreement remains unpaid, Company may pursue any lawful collection remedy available, including:
- collection efforts;
- referral to a collection agency;
- referral to an attorney; and/or
- appropriate civil legal action.
Any collection fee, attorney’s fee, court cost, late charge, or other additional amount will be assessed only to the extent permitted by applicable law.
Client understands that suspension or removal from CPP does not extinguish an unpaid contractual balance.
7. NO REFUNDS • NO CREDITS • NO MAKE-UPS • NO TRANSFERS
All payments are final and non-refundable.
There are no refunds, credits, prorations, transfers, make-up periods, or fee adjustments for ANY REASON, including but not limited to:
- missed attendance;
- school, team, AAU, or club schedules;
- travel or family scheduling;
- transportation issues;
- relocation;
- divorce
- Athlete’s loss of interest;
- injury, illness, mental health
- conflicts w/ coaches or peers
- emergency
- family issues
- voluntary withdrawal;
- dissatisfaction with attendance frequency; or
- Client’s decision not to fully use available Program access.
Or any other circumstance.
8. NO PAUSES • NO FREEZES • NO EXTENSIONS
The Program Term runs for twelve consecutive months beginning on Athlete’s enrollment date. (as long as all payments are made in the agreed time frame)
The Program Term does not pause because Athlete does not attend.
The Program may not be paused, frozen, carried over, or extended because of voluntary nonattendance or Client scheduling circumstances.
Unused Program time expires at the end of the Program Term.
This applies to any reason, including but not limited to:
- missed attendance;
- school, team, AAU, or club schedules;
- travel or family scheduling;
- transportation issues;
- relocation;
- divorce
- Athlete’s loss of interest;
- injury, illness, mental health
- conflicts w/ coaches or peers
- emergency
- family issues
- voluntary withdrawal;
- dissatisfaction with attendance frequency; or
- Client’s decision not to fully use available Program access.
Or any other circumstance.
9. ATTENDANCE RESPONSIBILITY
Client is solely responsible for Athlete’s attendance, transportation, and scheduling.
Failure to attend or fully use available Program opportunities does not, by itself, reduce or cancel an amount otherwise due under this Agreement.
10. ATHLETE & PARENT CONDUCT
Athlete and Client must behave safely, respectfully, appropriately, and cooperatively and comply with reasonable coaching instructions, Program procedures, facility rules, and parent/sideline policies.
Unsafe, threatening, abusive, disruptive, disrespectful, inappropriate, or repeatedly noncompliant conduct may result in immediate suspension or termination from CPP.
Termination resulting from Athlete’s or Client’s material violation of Program rules does not, by itself, cancel an amount otherwise lawfully due under this Agreement.
11. NO GUARANTEE OF RESULTS
Company makes no guarantee regarding:
- basketball skill improvement;
- confidence;
- playing time;
- roster or team selection;
- competitive outcomes;
- scholarships; or
- any other athletic result.
Results depend on numerous factors outside Company’s control, including Athlete’s effort, consistency, participation, practice habits, physical development, health, and application of instruction.
12. CHARGEBACKS & PAYMENT DISPUTES
A chargeback, card dispute, bank dispute, payment-provider dispute, or payment reversal does not, by itself, terminate this Agreement or automatically extinguish an otherwise valid contractual obligation.
Company may provide this Agreement, checkout acknowledgments, payment authorization, transaction records, communications, attendance information, and other relevant records when responding to a payment dispute.
Nothing in this Agreement waives a consumer right that applicable law does not permit Client to waive.
13. ASSUMPTION OF INHERENT ATHLETIC RISK
Client understands that basketball and athletic training involve inherent physical risks, including falls, collisions, contact, strains, sprains, fractures, and other injuries.
Client knowingly permits Athlete to participate with awareness of those inherent risks.
Nothing in this Agreement is intended to waive a right or claim that applicable law does not permit to be waived.
14. NO ORAL MODIFICATIONS
No verbal conversation, telephone call, informal discussion, or request by Client modifies this Agreement.
Any modification to the amount or due date of a payment must be expressly approved in writing by Nick Aldiero Basketball LLC.
Company’s decision to grant an accommodation on one occasion does not waive Company’s right to enforce the Agreement thereafter.
15. ELECTRONIC COMMUNICATIONS
Client consents to receive payment notices, failed-payment notices, Program communications, and contractual notices electronically at the email address and/or telephone number supplied by Client.
Client is responsible for maintaining accurate contact and payment information.
16. ELECTRONIC AGREEMENT & ACCEPTANCE
Client agrees to conduct this transaction electronically.
By checking the required acknowledgment boxes and completing the SamCart order, Client intends to electronically accept and be legally bound by this Agreement and the payment obligations described herein.
Client’s electronic acceptance and checkout records may be retained as evidence of Client’s agreement.
17. GOVERNING LAW
This Agreement is governed by the laws of the State of New Jersey.
Any action concerning this Agreement may be brought in a court of competent jurisdiction as permitted by applicable law.
18. ENTIRE AGREEMENT
This Agreement, together with the specific payment acknowledgments accepted by Client during checkout, constitutes the agreement between Company and Client concerning Athlete’s CPP enrollment.
Client acknowledges that no verbal statement that directly contradicts these written terms modifies this Agreement.
19. SEVERABILITY
If any provision of this Agreement is found invalid or unenforceable, that provision shall be limited or severed only to the extent necessary, and the remaining provisions shall continue in effect to the fullest extent permitted by law.
Any contractual fee, remedy, charge, or obligation subject to a statutory limitation shall automatically be limited to the amount permitted by applicable law.
20. NO WAIVER
Company’s failure or delay in enforcing a contractual right on one occasion does not waive that right or require Company to grant the same accommodation in the future.
Any waiver or modification by Company must be express and in writing.
21. CLIENT’S KEY PAYMENT ACKNOWLEDGMENT
By completing enrollment, Client specifically acknowledges and agrees that:
- the total purchase price is $6,400;
- $3,200 is due immediately at enrollment;
- $3,200 is due and authorized to be automatically charged December 15, 2026;
- the second $3,200 payment is a binding contractual obligation and is not optional;

- a failed second payment results in immediate suspension of Athlete’s CPP access;
- Athlete may be removed from CPP if the payment remains unpaid;
