Committed Player Program

Terms & Conditions

IMPORTANT: PLEASE READ BEFORE ENROLLING

By signing up for the Committed Player Program, you acknowledge that you have read, understand, and fully agree to the terms and conditions outlined in this agreement. Only enroll if you agree to all policies stated below. By completing the payment, you legally accept these terms and commit to full compliance. No exceptions will be made.

1. No Refund/Credit Policy:
Enrollment in the Committed Player Program is a commitment and carries inherent risks. No refunds, credits, or make-up sessions will be provided under any circumstances, including but not limited to absences due to injury, illness, scheduling conflicts, emergencies, or any other event beyond the control of Nick Aldiero Basketball LLC. Additionally:

 The athlete’s spot is non-transferable to any other individual, including siblings.
Any missed session is considered forfeited and cannot be rescheduled.
The program will not be paused, held, delayed, or extended for any reason.
Participants acknowledge the risk of unexpected events that may impact attendance. By enrolling, participants accept this risk in full.

 

2. Program Duration (Start & End Date):
The Committed Player Program provides one year (12 months) of access. The official start date begins on the date of payment and concludes exactly one year from that date.

The program will not be paused, held, delayed, or extended under any circumstances.
Time lost due to personal conflicts, holidays, or gym availability will not result in an extension of program duration.

 

3. Payment Policy:
If enrolling one athlete into the Committed Player Program, participants agree to pay the full program fee of $3,000, regardless of usage.

If enrolling two athlete's (siblings) into the Committed Player Program, participants agree to pay the full program fee of $4,500, regardless of usage.

If using a buy now, pay later service, the participant remains fully responsible for making payments directly to the third-party provider regardless of use of service

 

4. Client Responsibility for Dates & Time Reminders:
It is the sole responsibility of the participant to track their program duration, training schedule, and session reminders.

Participants must proactively seek any necessary information regarding their program schedule.

 

5. Rate Policy:
Program pricing is subject to change. To retain the same rate, participants must re-enroll before their current term ends. Failure to do so may result in a higher program fee upon re-enrollment.

 

6. Results Disclaimer:
Nick Aldiero Basketball LLC does not guarantee specific results. Athlete performance is based on individual effort, work ethic, ability, and commitment to training both in-session and independently at home.

 

7. No Freeze/Pause Payment Policy:
The program cannot be frozen, paused, delayed, or extended for any reason. This includes, but is not limited to, injury, illness, scheduling conflicts, personal circumstances, or any other event.

 

8. Program Modifications:
Nick Aldiero Basketball LLC reserves the right to modify, adjust, or update the program structure, schedule, or content at any time.

 

9. Time & Attendance Policy:
Sessions begin and end on time. Any time missed due to late arrival is considered forfeited.

Athletes should arrive 5-10 minutes early to warm up and prepare.
Each training session is 60 minutes in duration.

 

10. Schedule & Location Policy:
Training sessions may take place anywhere within Monmouth or Ocean County, New Jersey.While we strive for consistency, training days, times, and locations may change as necessary.

Gym availability is subject to change. Holidays, facility closures, and unforeseen circumstances may result in session cancellations.

Program duration will not be extended due to gym unavailability, as ample training opportunities are provided throughout the year.

 

11. Player Expectations:
All participants are expected to:
Arrive on time and be prepared.
Demonstrate a positive attitude and strong work ethic.
Be coachable, listen attentively, and follow instructions.
Train independently by completing assigned at-home training (homework academy).
Bring the required materials to each session, including a journal, pen, basketball, and water.

 

12. No Coaching Policy for Parents/Guardians:
Parents and spectators are not permitted to coach, yell, or gesture from the sideline during training sessions.
Communication with athletes must wait until after the session, unless there is an emergency or injury.

 

13. Refusal of Service Policy:
Nick Aldiero Basketball LLC reserves the right to refuse service or remove any player or parent from the program at any time for reasons including, but not limited to:
Disruptive, disrespectful, or inappropriate behavior.
Failure to follow instructions, policies, or program guidelines.
Any conduct deemed harmful to the training environment, staff, or other participants.
Non-payment or failure to meet financial obligations 

By enrolling in the Committed Player Program with Nick Aldiero Basketball LLC, participants and their legal guardians acknowledge and agree to the terms outlined in this Agreement. These policies are in place to ensure a structured, professional, and effective training environment for all athletes.

RELEASE OF LIABILITY FOR MINOR PARTICIPANTS
BY BECOMING A MEMBER OF OUR PROGRAM, YOU ARE ACKNOWLEDGING THAT YOU HAVE READ & AGREE TO THE FORM BELOW
IN CONSIDERATION OF my child/ward being allowed to Name Of Minor Child/Ward participate in any way in the Nick Aldiero Basketball LLC related events and activities, the undersigned acknowledges, appreciates, and agrees that:

The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to my child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

1. FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and,

2. I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; and,

3. I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Nick Aldiero Basketball LLC; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releases from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

5. I, the parent/guardian, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
UNDERSTANDING OR RISK

I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulation, and accept them as a participant.

RELEASE OF MEDIA FORM

I hereby grant Nick Aldiero Basketball LLC and their agents, the absolute right and permission to use photographic portraits, pictures, or digital images of My Child, or in which My Child may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any sports publication, social media, or website of any entity within the Nick Aldiero Basketball LLC building, without payment or any other consideration. I hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein My Child’s likeness appears, or the use to which it may be applied.

I hereby release, discharge, and agree to indemnify and hold harmless Nick Aldiero Basketball LLC, or any agent/entity within Nick Aldiero Basketball LLC, from all claims, demands, and causes of action that I or My Child have or may have by reason of this authorization or use of My Child’s photographic portraits, pictures, or digital images, including any liability by virtue of any blurring,distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said images or in processing tending towards the completion of the finished product, including publication to the internet, in brochures, or any other advertisements or promotional materials.
