Terms & Conditions: Nick Aldiero Basketball LLC

By enrolling in any Nick Aldiero Basketball LLC event, clinic, camp, program or training session, you (the participant or the legal guardian of the participant) agree to the following Terms & Conditions, including our Liability Waiver and Media Release Form. These terms are designed to protect our athletes, families, and business.

đź”’ GENERAL POLICY

  • NO REFUND & NO MAKE UP / NO CREDIT POLICY:
    • All sales are final. No refunds & No Make Ups or Credits are issued for any reason. This includes any missed days / sessions or time for any reason: including, but not limited to: injury, illness, family emergencies, scheduling conflicts, or unforeseen circumstances.
    • Sessions are not transferable to others (including siblings).
    • Payment is only valid for the specific date/time purchased and cannot be applied to future events or services regardless of the reason or circumstance as stated above.
    • SIGN UP AT YOUR OWN RISK
  • Clinic / Camp Structure: All clinics are run by Coach Nick Aldiero and his assistant coaches in a large group setting. There is no guarantee Coach Nick Aldiero will personally coach your child during any given session. In the rare event Coach Nick cannot attend, qualified assistant coaches will lead the session in full. By signing up, you acknowledge and accept this.
  • Group Format Acknowledgment: At times, athletes may have to wait before participating in gameplay or drills. This is standard in a group training environment.
  • Skill Level: The skills we work on are challenging & based on the older players in the group. We allow younger players (3rd - 9th) but everyone in the group does the skills which are challenging especially for those younger players. For the most part, the skills we work on are not for beginners.
  • Spectator Policy:
    • No coaching, yelling, or gesturing is permitted from the sidelines.
    • Parents/spectators must remain off the court unless there is an emergency.
    • Any violation of this policy may result in removal or permanent banning from all future events.
  • Gym Locations: We reserve the right to relocate the event to another gym based on availability, safety, or operational needs.
  • Refusal of Service: Nick Aldiero Basketball LLC reserves the right to refuse service to anyone for any reason, including inappropriate behavior, lack of coachability, or violation of our policies. Any player / parent can be removed at any for not having proper conduct. There will be no refund & no credit / make up either for being removed.
  • Bring Your Own BASKETBALL & WATER: Athletes are expected to bring their own basketball and water to each session. We do not provide basketballs or water.
  • Player Conduct: Players are expected to demonstrate a coachable attitude, positive body language, and respect toward all coaches and peers. Any player / parent can be removed at any for not having proper conduct. There will be no refund & no credit / make up either for being removed.

WAIVER FORM: RELEASE OF LIABILITY FOR MINOR PARTICIPANTS  

BY MAKING PAYMENT & CHECKING OUR WAIVER RELEASED BOX ON OUR ENROLLMENT PAGE, YOU ARE ACKNOWLEDGING THAT YOU HAVE READ & AGREE TO THE FORM BELOW
IN CONSIDERATION OF my child/ward being allowed to Name Of Minor Child/Ward participate in any way in the Nick Aldiero Basketball LLC related events and activities, the undersigned acknowledges, appreciates, and agrees that:
 
The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to my child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,
 
1. FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and,
 
2. I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; and,
 
3. I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Nick Aldiero Basketball LLC; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
 
4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releases from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
 
5. I, the parent/guardian, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.
 
I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
UNDERSTANDING OR RISK
 
I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulation, and accept them as a participant.
 

RELEASE OF MEDIA FORM

I hereby grant Nick Aldiero Basketball LLC and their agents, the absolute right and permission to use photographic portraits, pictures, or digital images of My Child, or in which My Child may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any sports publication, social media, or website of any entity within the Nick Aldiero Basketball LLC building, without payment or any other consideration. I hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein My Child’s likeness appears, or the use to which it may be applied. I hereby release, discharge, and agree to indemnify and hold harmless Nick Aldiero Basketball LLC, or any agent/entity within Nick Aldiero Basketball LLC, from all claims, demands, and causes of action that I or My Child have or may have by reason of this authorization or use of My Child’s photographic portraits, pictures, or digital images, including any liability by virtue of any blurring,distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said images or in processing tending towards the completion of the finished product, including publication to the internet, in brochures, or any other advertisements or promotional materials.

AGREEMENT TO TERMS

By submitting payment and enrolling, you confirm that you:

  • Have read and agree to these Terms & Conditions in full.
  • Understand that participation is at your own risk.
  • Acknowledge and accept the structure of our clinics and training sessions.
