Terms & Conditions: Lil Hoopers Academy – Nick Aldiero Basketball LLC

By enrolling in the Lil Hoopers Academy with Nick Aldiero Basketball LLC, you acknowledge and agree to all terms and conditions and Release of Liability Waiver / Media Release outlined below. These terms are legally binding and designed to protect all parties involved. 

No Refund / No Credit / No Makeup Policy

• All payments are final. No refunds, No credits, No makeup sessions, No pauses/freezes or extensions & No transfers will be granted for any reason. This includes missed sessions, regardless of the reason (including but not limited to illness, injury, emergency, vacation, scheduling conflict, or any other event.)

• No Pause/Freeze Policy: Subscriptions cannot be paused, frozen, delayed, or extended for any reason including, but not limited to, injury, illness, emergency, vacation, or scheduling conflict. Any time missed is forfeited. 

• Participants and families waive the right to initiate chargebacks, payment disputes, or refund requests for any reason once payment is processed.

• Sessions are non-transferable, including to siblings or friends.

• Payment is valid only for the original program and date/time selected.

Subscription & Payment Terms

• Subscription Options for 1 Player: 

  • $397 every 12 weeks (84 days) — 84-day access

• Subscription Options for 2 Player's (siblings): 

  • $595.50 every 12 weeks (84 days)  — 84-day access

• Auto-Renewal Policy: By enrolling, you authorize Nick Aldiero Basketball LLC to automatically charge your card on file every 12 weeks (84 days) by your selected subscription rate on a recurring basis until cancellation is submitted in writing via email to [email protected] with the subject line "Cancellation".

• Usage Window: Athletes must attend sessions within their selected payment window: Once payment is made or renews your athlete's time in the program starts

  • 12 Week Auto Renewal Plan: 84 days 

  •   Any sessions not used within this window are forfeited and cannot be extended or credited.

• No Pause/Freeze Policy: Subscriptions cannot be paused, frozen, delayed, or extended for any reason including, but not limited to, injury, illness, emergency, vacation, or scheduling conflict.

• Cancellation Policy: You may cancel at any time by emailing [email protected] with the subject line "Cancellation". Cancellations must be made in writing via email and will take effect prior to the next billing cycle. In-person cancellations are not valid. Be sure to set your own reminders as it's your responsibility to remember to cancel. Nick Aldiero Basketball LLC is not responsible to remind you about your automatic renewal payment going through.

• Failed Payment: If payment fails, training will be immediately suspended. You have 12 hours to update payment information or your spot may be forfeited. Missed sessions due to failed payment are also forfeited.

• Rate Policy: Pricing and terms are subject to change for new or returning members not currently subscribed. Active subscriptions are grandfathered until canceled.

• Cannot pay difference: You may not pay the difference between subscriptions. To upgrade you must complete your initial term first. To upgrade contact us at [email protected]

• Refusal of Service: Nick Aldiero Basketball LLC reserves the right to refuse service to any participant or parent/guardian for any reason, including but not limited to inappropriate behavior, safety concerns, or failure to follow policies.

• Chargeback / Dispute Waiver
  By enrolling, you waive the right to dispute or reverse charges (“chargebacks”) through your bank or credit card provider for any reason related to dissatisfaction, non-attendance, or disagreement with program policies.
  Any attempt to initiate a chargeback or payment dispute constitutes a breach of this Agreement, entitling the Company to recover all associated costs, including legal fees, collection costs, and any bank or processor penalties. 

Program & Session Conditions

• Program Structure: The regular day & time of the program is Sunday's 12:15pm - 1:15pm in Ocean Twp, NJ BUT the Day, time, and location are subject to change. We will make every effort to maintain consistency but reserve the right to adjust as necessary. By enrolling, you acknowledge and accept this risk.

• Wait Time: Depending on attendance levels and structure of the day’s session, athletes may be asked to wait or rotate in and out of play.

• Coach Availability: There is no guarantee that Coach Nick Aldiero will personally coach your child or every session. Qualified staff and trainers may lead sessions as needed.

• Group Coaching: Our sessions are all group coaching not personal / 1 on 1. There is no guarantee your child will receive individual coaching. 

• Player Grouping: There is no guarantee that your child will train with other athletes of similar age, gender, size, or ability.

• Refusal of Service: Nick Aldiero Basketball LLC reserves the right to refuse service to any participant or parent/guardian for any reason, including but not limited to inappropriate behavior, safety concerns, or failure to follow policies.

Player Code of Conduct

All participants must:

• Listen to and follow coach instructions.

• Show respect and sportsmanship to all participants and staff.

• Avoid disruptive, aggressive, or disrespectful behavior.

• Try their best during all activities.

Failure to follow these guidelines may result in:

• Verbal warning

• Temporary removal from activities

• Dismissal from the program without refund

Parent/Guardian Code of Conduct

All parents/guardians must:

• Remain off the court unless explicitly invited.

• Refrain from coaching, directing, or distracting athletes.

• Address all questions via email in writing, not at our training sessions as that is not the time because too much is going on.

• Exhibit respectful behavior toward staff and other families.

• Ensure prompt arrival and pickup.

• Ensure that siblings in attendance remain seated and quiet throughout the session. Siblings are not allowed to bring a ball or any other toy with them that can be distracting. 

• If your automatic payment fails 3 times you & your athlete are removed from the program

Violation of these rules may result in permanent removal from the program without refund.

Nick Aldiero Basketball LLC – Liability & Media Waiver (Lifetime Validity)

RELEASE OF LIABILITY, ASSUMPTION OF RISK, & INDEMNIFICATION AGREEMENT – MINOR PARTICIPANT

By registering for any event, program, evaluation or basketball training session with Nick Aldiero Basketball LLC, you are acknowledging and agreeing to the following terms:

IN CONSIDERATION of my minor child/ward being allowed to participate in any capacity (including but not limited to evaluation sessions, basketball training programs, clinics, camps, or events) organized or run by Nick Aldiero Basketball LLC, the undersigned parent/guardian acknowledges and agrees that:

1. Comprehensive Scope
This waiver applies to all activities facilitated by Nick Aldiero Basketball LLC — including evaluation sessions, training programs, and any future participation — and remains valid indefinitely unless revoked in writing. By signing this once, you waive all related liability now and in the future, including if your athlete is later accepted into the program.

2. Inherent Risks Acknowledged
Participation in physical activities such as basketball inherently includes risk of injury or illness (including but not limited to MRSA, influenza, COVID-19), which may result in serious harm, disability, or death. These risks exist despite safety measures and participant discipline.

3. Assumption of Risk
I, on behalf of myself, my spouse, and my child/ward, knowingly and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of Nick Aldiero Basketball LLC or associated parties.

4. Voluntary Participation
I acknowledge that participation in Nick Aldiero Basketball LLC activities is purely voluntary and that I am under no obligation to enroll my child/ward in any training, clinic, or event.

5.Compliance and Removal Clause
I agree to comply with all guidelines, instructions, and safety procedures. If I observe any unusual hazard or my child becomes unfit to participate, I will notify a staff member and withdraw them immediately.

6. Waiver of Liability
I, for myself, my spouse, my child, and our heirs, assigns, and personal representatives, fully release, waive, and discharge Nick Aldiero Basketball LLC, its coaches, employees, agents, venue owners, sponsors, and volunteers from any and all claims for injury, illness, disability, death, or property damage related to participation — even if due to negligence.

7. Indemnification
I agree to indemnify and hold harmless all released parties from any claims, liabilities, damages, or legal costs arising from my child’s participation, including claims brought by third parties.

8. Media Release
I grant Nick Aldiero Basketball LLC and its agents full permission to photograph or record my child and to use their image in promotional materials, websites, and social media, without compensation. I waive any rights to inspect or approve such materials.

9. Legal Enforceability
I acknowledge that this agreement is binding, legally enforceable, and governed by the laws of the State of New Jersey. Any legal proceedings shall be brought in Monmouth or Ocean County, NJ at the sole discretion of Nick Aldiero Basketball LLC.

10. No Modification
No oral or written statements outside of this waiver shall modify its terms. This agreement constitutes the entire understanding between the parties.

11. Digital Signature Validity
I agree that the act of checking any box with Nick Aldiero Basketball LLC is considered my legal digital signature shall have the same legal force and effect as a handwritten signature.

Acknowledgment & Agreement

By making payment, I affirm and agree that:

• I am the legal parent/guardian of the participant.
• I have read, understood, and voluntarily agree to the Nick Aldiero Basketball LLC Liability Waiver & Media Release in full, without inducement, coercion, or reliance on any statements not contained in the document.
• I understand and agree that this waiver applies to all current and future participation in any and all activities, programs, events, or training sessions offered by Nick Aldiero Basketball LLC, whether on-site, off-site, or virtual.
• I understand this is a legally binding contract enforceable under the laws of the State of New Jersey.
• I accept that by signing, I am waiving certain legal rights, including the right to sue, to the maximum extent permitted by law.
