Committed Player Program – Terms & Conditions / Agreement
IMPORTANT – LEGALLY BINDING AGREEMENT
This Agreement is a legally binding contract between Nick Aldiero Basketball LLC (“Company”) and the undersigned participant and/or their legal guardian. By enrolling in the Committed Player Program, you confirm that you have read, understood, and accepted all terms in this Agreement. You voluntarily assume all risks and obligations described herein.
1. No Refund / No Credit / No Make-Up / No Transfer / No pause, freeze or extension Policy
Enrollment in this special offer gives you access to the Committed Player Program for 2 years from the agreed upon date. This is a special time limited offer and is not a regular offer within our options.
All payment are final. No refunds, No credits, No make-ups, No freezes/holds/pauses, No extensions and No transfers or fee adjustments will be provided under any circumstances, whether foreseeable or unforeseeable, including but not limited to: absence, injury, illness, vacation, scheduling conflict, relocation, emergencies, facility closure, or any other event.
This no-refund, no-credit, no-make-up policy applies regardless of any change in the athlete’s schedule, priorities, health, interest level, or any other circumstance, whether within or outside of the athlete’s control.
Enrolling is a voluntary acceptance of this risk. Missed sessions are forfeited and cannot be rescheduled. The program cannot be paused, extended, or delayed for any reason.
2. Non-Transferability
Your enrollment and athlete spot are non-transferable and may not be assigned, sold, or given to any other individual, including siblings.
3. Program Scope
Enrollment applies only to the basketball training sessions and benefits specifically included in this program. And access to 12 months of clinics/camps starting immediately once payment is made. That access ends after 12 months and is not extended or paused for any reason. Zero Exceptions. After 12 months those events must be paid.
4. Duration
Access begins on the agreed upon date which is at the decision & discretion of Coach Nick Aldiero & ends two years later. No extensions will be granted for any reason, including but not limited to those listed in Section 1.
5. Payment Obligation
One Athlete: $4,500 for 24 months
Two Athletes (siblings): $6,750 for 24 months
Payment is due in full via Stripe or an approved third-party financing service (Affirm, Klarna, Afterpay, PayPal).
If financing is used, you remain solely responsible for completing all payments to the financing provider regardless of program usage.
Payment is an unconditional obligation and is not contingent upon attendance, participation, or athlete satisfaction.
Failure to attend sessions does not excuse payment obligations.
6. Client Responsibility
It is your sole responsibility to track program dates, session schedules, and attendance.

8. Results Disclaimer
The Company does not guarantee specific results. Athlete progress depends on individual effort, work ethic, and commitment both in-session and outside of training.
9. Program Changes
The Company reserves the right to modify program structure, schedule, location, or staffing at any time without liability, provided reasonable training opportunities remain available.
10. Attendance Policy
Sessions start and end on time. Late arrival reduces your session time and will not be made up.
Athletes must arrive 5–10 minutes early with all required gear: basketball, journal, pen, and water.
11. Locations & Schedule
Sessions may be held anywhere in Monmouth or Ocean County, NJ. Days, times, and locations are subject to change.
Program duration will not be extended due to gym changes, closures, or relocations.
12. Player Expectations
Athletes must:
Arrive on time and prepared.
Maintain a positive attitude, be coachable, and follow instructions.
Complete assigned at-home training.
13. Parent/Spectator Conduct
Parents/guardians may not coach, yell, or otherwise interfere during sessions.
Communication with athletes must wait until after training unless urgent.
14. Refusal of Service
The Company reserves the right to remove any player or parent — with no refund or credit — for:
Disrespectful, disruptive, or unsafe behavior.
Failure to follow instructions, program rules, or payment obligations.
15. Chargeback / Dispute Waiver
By enrolling, you waive the right to dispute or reverse charges (“chargebacks”) through your bank or credit card provider for any reason related to dissatisfaction, non-attendance, or disagreement with program policies.
Any attempt to initiate a chargeback or payment dispute constitutes a breach of this Agreement, entitling the Company to recover all associated costs, including legal fees, collection costs, and any bank or processor penalties.Â
TERMS & CONDITIONS / AGREEMENT – By making payment, I confirm that I have read, understood, and agree in full to the Terms & Conditions / Agreement of the Committed Player Program offered by Nick Aldiero Basketball LLC. I understand this is a legally binding contract for a 12-month enrollment with no refunds, no credits, no make-ups, no pauses, no extensions, or transfers for any reason, and that I am responsible for the full program fee regardless of attendance. I voluntarily accept these terms without coercion.
Nick Aldiero Basketball LLC – Liability & Media Waiver (Lifetime Validity)
RELEASE OF LIABILITY, ASSUMPTION OF RISK, & INDEMNIFICATION AGREEMENT – MINOR PARTICIPANT
By registering for any event, program, evaluation or basktball training session with Nick Aldiero Basketball LLC, you are acknowledging and agreeing to the following terms:
IN CONSIDERATION of my minor child/ward being allowed to participate in any capacity (including but not limited to evaluation sessions, basketball training programs, clinics, camps, or events) organized or run by Nick Aldiero Basketball LLC, the undersigned parent/guardian acknowledges and agrees that:
1. Comprehensive Scope
This waiver applies to all activities facilitated by Nick Aldiero Basketball LLC — including evaluation sessions, training programs, and any future participation — and remains valid indefinitely unless revoked in writing. By signing this once, you waive all related liability now and in the future, including if your athlete is later accepted into the program.
2. Inherent Risks Acknowledged
Participation in physical activities such as basketball inherently includes risk of injury or illness (including but not limited to MRSA, influenza, COVID-19), which may result in serious harm, disability, or death. These risks exist despite safety measures and participant discipline.
3. Assumption of Risk
I, on behalf of myself, my spouse, and my child/ward, knowingly and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of Nick Aldiero Basketball LLC or associated parties.
4. Voluntary Participation
I acknowledge that participation in Nick Aldiero Basketball LLC activities is purely voluntary and that I am under no obligation to enroll my child/ward in any training, clinic, or event.
5.Compliance and Removal Clause
I agree to comply with all guidelines, instructions, and safety procedures. If I observe any unusual hazard or my child becomes unfit to participate, I will notify a staff member and withdraw them immediately.
6. Waiver of Liability
I, for myself, my spouse, my child, and our heirs, assigns, and personal representatives, fully release, waive, and discharge Nick Aldiero Basketball LLC, its coaches, employees, agents, venue owners, sponsors, and volunteers from any and all claims for injury, illness, disability, death, or property damage related to participation — even if due to negligence.
7. Indemnification
I agree to indemnify and hold harmless all released parties from any claims, liabilities, damages, or legal costs arising from my child’s participation, including claims brought by third parties.
8. Media Release
I grant Nick Aldiero Basketball LLC and its agents full permission to photograph or record my child and to use their image in promotional materials, websites, and social media, without compensation. I waive any rights to inspect or approve such materials.
9. Legal Enforceability
I acknowledge that this agreement is binding, legally enforceable, and governed by the laws of the State of New Jersey. Any legal proceedings shall be brought in Monmouth or Ocean County, NJ at the sole discretion of Nick Aldiero Basketball LLC.
10. No Modification
No oral or written statements outside of this waiver shall modify its terms. This agreement constitutes the entire understanding between the parties.
11. Digital Signature Validity
I agree that my digital signature provided through JotForm or any other platform shall have the same legal force and effect as a handwritten signature.
Acknowledgment & Agreement
By making payment, I affirm and agree that:
- I am the legal parent/guardian of the participant.
- I have read, understood, and voluntarily agree to the Nick Aldiero Basketball LLC Liability Waiver & Media Release in full, without inducement, coercion, or reliance on any statements not contained in the document.
- I understand and agree that this waiver applies to all current and future participation in any and all activities, programs, events, or training sessions offered by Nick Aldiero Basketball LLC, whether on-site, off-site, or virtual.
- I understand this is a legally binding contract enforceable under the laws of the State of New Jersey.
- I accept that by signing, I am waiving certain legal rights, including the right to sue, to the maximum extent permitted by law.
